TERMS AND CONDITIONS


THIS AGREEMENT comprises the particulars detailed above and the terms and conditions printed overleaf whereby the Apartment is licensed and taken by the Licensee for occupation during the Period upon making the Payment.

AGREEMENT FURNISHED APARTMENT

TERMS AND CONDITIONS

  1. The Licensee will:
    1. Only in conjunction with the occupation of the Apartment be allowed to share with the other occupiers of the Property the use and facilities of the common parts of the Property.
    2. Pay the payment at the times and in the manner aforesaid without any deduction or abatement of set-off whatsoever.
    3. Keep the interior of the apartment in a good clean and tenantable state and condition and not damage or injure the Property or any part of it.
    4. Yield up the apartment at the end of the Period in the same clean state and condition it was at the beginning of the Period.
    5. Maintain the apartment and keep in a good and clean condition all of the fixtures, fittings and chattels.
    6. Not make any alteration or addition to the apartment nor without the Licensor's prior written consent to do any redecoration or painting of the apartment.
    7. Not do or omit to do anything on or at the Property which may be or become a nuisance or annoyance to the Licensor or any other occupiers of the Building or owners or occupiers of adjoining or nearby premises or which may in any way prejudice the insurance of the Property or cause an increase in premium payable therefore.
    8. Not without the Licensor's prior consent allow or keep any pet of any kind of animal at the Property.
    9. Not use or occupy the Apartment in any way whatsoever other than as a private residence.
    10. Not assign, sublet, charge or part with or share possession or occupation of the Apartment or any part thereof.
    11. Pay interest at the rate of 4% above the Base Lending Rate for the time being of the Licensor's bankers upon any payment or other money due from the Licensee under this Agreement which is more than 10 days in arrears in respect of the period from when it becomes due down to the date of the payment.
  2. In the event of the Payment being unpaid for more than 10 days after it is due (whether demanded or not) or there being a breach of any other of the Licensee's obligations under this Agreement then the Licensor may re-enter the Apartment and this Agreement shall thereupon determine absolutely but without prejudice to any of the Licensor's other rights and remedies in respect of any outstanding obligations on the part of the Licensee.
  3. The Deposit has been paid by the Licensee and is held by the Licensor to secure compliance with the Licensee's obligations under this Agreement (without prejudice to the Licensor's other rights and remedies) and if, at any time during the Period, the Licensor is obliged to draw upon it to satisfy any outstanding breaches of such obligations then the Licensee shall forthwith make such additional payment as is necessary to restore the full amount of the Deposit held by the Licensor. As soon as reasonably practicable following determination of this Agreement the Licensor shall return to the Licensee the Deposit or the balance thereof after any deductions properly made.
  4. The Licensor hereby notifies the Licensee that any notices (including notices in proceedings) should be served upon the Licensor of the address stated with the name of the Licensor overleaf.
  5. In the event of damage to or destruction of the Property by any of the risks insured against by the Licensor the Licensee shall be relieved from making the Payment to the extent that the Licensee's use and enjoyment of the Property is thereby prevented and from performance of its obligations as to the state and condition of the Property to the extent of and whilst there prevails any such damage or destruction (except to the extent that the insurance is prejudiced by any act or default of the Licensee).
  6. Where the context so admits:
    1. The "Licensor" includes the successors in title to the Licensor's interest in the Property.
    2. The "Property" includes all of the Licensor's fixtures and fittings at or upon the Property.
    3. The "Period" shall mean the period stated in the particulars overleaf.
  7. All references to the singular shall include the plural and vice versa and any obligations or liabilities of more than one person shall be joint and several and an obligation on the part of a party shall include an obligation not to allow or permit the breach of that obligation.
  8. The Licensor accepts no liability for any damage, vandalism to or theft of any motor vehicles belonging to the Licensee during the Period. All off-road parking, underground parking and on-road parking facilities are offered at the Licensee's own risk. The Licensee is advised to check that their own insurance policy offers adequate protection for such eventualities during the Period.
  9. For the avoidance of doubt, neither the Company nor the Owner will be responsible for any financial loss or damage to belongings of any persons permitted to occupy the property or for any injuries sustained by them or any member of their party (save that this disclaimer does not apply to death or personal injury caused by negligence). We recommend that you take out insurance to cover any loss or damage or personal injury.

METHOD OF PAYEMNT

The balance of up to 1 month's rent is payable on arrival. Thereafter, the monthly payment is payable in advance either by cheque (payable to Kenwood Apartments) or by standing order until the end of the lettings period.

THE DEPOSIT

A deposit of £100.00 is required at the time of booking to reserve the apartment.
